Creator Incubator - Terms of use.

These terms of use ("Agreement") govern your participation in the Creator+ Program ("the Course") offered by Nest Talent Pty Ltd ("Nest Talent," "we," "our," or "us"). By enrolling in the Course, you ("participant," "you," or "your") agree to abide by these terms and conditions.

1. Course Description

The Creator+ Program ("the Course") offered by Nest Talent Pty Ltd is designed to equip aspiring content creators with an array of valuable skills and knowledge. Throughout the course, participants will learn how to craft compelling content, engage their audience effectively, and implement successful monetization strategies. From shaping a unique persona to mastering the nuances of content creation, the Course empowers participants to flourish in the digital realm.

2. Access and Use

Upon enrolling in the Course, you are granted non-exclusive, non-transferable access to the course materials for personal use during the course duration. The materials are confidential and cannot be shared, distributed, or reproduced in any form. All course materials are protected by copyright, and any unauthorised use, reproduction, distribution, or exploitation of the materials is strictly prohibited.

3. User Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activities associated with your account. Any communication with instructors or fellow participants should uphold the standards of professionalism and respect.

4. Instructor Interaction

Instructor interaction offers a unique opportunity for engagement. While interactions may vary based on the program, all participants are encouraged to actively participate in relevant discussions and utilise provided communication channels for queries and feedback.

5. Intellectual Property

All course materials, including videos, documents, resources, and proprietary tools, are the exclusive intellectual property of Nest Talent Pty Ltd. Participants are strictly prohibited from reproducing, distributing, sharing, or exploiting the materials for any commercial or non-commercial purposes without explicit written consent.

By enrolling in the Course, participants grant Nest Talent Pty Ltd the right to utilise any ideas or feedback submitted as part of the program for the purposes of enhancing the educational experience.

Participants acknowledge that Nest Talent Pty Ltd shall not be liable for any damages, losses, or liabilities arising from the use of the course materials by the participants.

This addition highlights that participants are responsible for their use of the course materials and that Nest Talent Pty Ltd is not responsible for any consequences that may result from such use.

6. Enrollment and Payment

Enrollment in the Course requires payment of the specified fee. Payment terms, including the payment schedule and refund policy, will be detailed during the enrollment process.

7. Refund Policy

Nest Talent Pty Ltd offers a 7-day refund policy for the Creator+ Program. If you cancel your enrolment within 7 days of enrolling, you will receive a full refund. The refund will be processed within 5 days of the cancellation request.

8. Progress and Completion

Course progress hinges on fulfilling requirements, assignments, and assessments. Successful completion entails participating in discussions, submitting assignments, quizzes, and projects.

9. Feedback and Assessment

Nest Talent Pty Ltd provides valuable feedback at intervals. Assessment details, frequency, and methods are communicated during the course.

10. Technical Requirements

To access the course materials, participants must meet the following minimum technical requirements:

Device: Windows 10 or macOS 10.15 or later
Browser: Google Chrome or Mozilla Firefox
Internet Speed: A stable internet connection with a minimum speed of 10 Mbps or faster is recommended for optimal access and streaming of course content.
Nest Talent Pty Ltd assumes no liability for technical problems that may prevent participants from accessing the course materials.

11. Privacy and Data Usage

Personal information follows our Privacy Policy. Details on data collection, usage, and sharing are outlined in the policy.

12. Earnings Disclaimer

a. No Guarantee of Earnings: Nest Talent Pty Ltd does not guarantee specific income or financial results. Testimonials and success stories are not indicative of future outcomes.

b. Individual Results: Earnings vary due to effort, commitment, market conditions, etc. Individual success differs.

c. Financial Responsibility: Nest Talent Pty Ltd is not responsible for any financial losses that participants may incur as a result of taking the course. Nest Talent Pty Ltd cannot guarantee that participants will achieve any specific financial results as a result of taking the course.

13. Performance Guarantee and User Obligations

a. Performance Guarantee: Nest Talent Pty Ltd commits to assisting if participants fulfill obligations. The performance guarantee is only valid if the participant meets all program requirements and follows instructions diligently.

b. User Obligations: Participants must engage actively, complete assignments, and follow instructions. After two warnings, Nest Talent Pty Ltd's responsibility shifts. Nest Talent will not be responsible for any failures on the part of the participant to meet the requirements.

14. Termination and Refunds

Nest Talent Pty Ltd reserves the right to terminate access to the course materials for any reason, including but not limited to violations of the terms of use or disruptive behaviour. In cases of termination, no refunds will be issued for access to the course materials that have already been granted.

15. Dispute Resolution

Disputes are resolved through arbitration or mediation as specified in our Dispute Resolution Policy.

16. Changes to the Course

Nest Talent Pty Ltd reserves the right to make changes to the course materials, terms of use, or any other aspect of the Creator+ Program at any time. Participants will be informed of significant changes.

17. Limitation of Liability

Nest Talent Pty Ltd isn't liable for direct/indirect damages. Participants accept risks.

18. Governing Law

Terms are governed by laws of Queensland, Australia. Legal actions are under Queensland's jurisdiction.

19. Entire Agreement

Terms constitute the entire agreement, superseding prior understandings.
